Terms of Service

1. Agreement to Terms

By accessing or using the services provided by Vsurge Media (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use our services.

These terms apply to all visitors, users, and clients who access or use our services, including the “Webcraft” custom website development package.

2. Service Description

Vsurge Media provides custom website development services. Our Webcraft package (₹5,499 one-time payment) includes:

  • A custom-coded website with up to 5 pages
  • Custom domain registration and hosting for the first year
  • WhatsApp chat button integration
  • Google Analytics 4 setup
  • Facebook/Instagram Pixel installation
  • Basic AI chatbot setup
  • Product/service catalogue page
  • Google My Business integration
  • Social media linking
  • Custom lead capture/enquiry form

3. Pricing & Payment

Price: The Webcraft package is priced at ₹5,499 (Indian Rupees Five Thousand Four Hundred and Ninety-Nine) as a one-time payment. This price is inclusive of all deliverables listed in Section 2.

Payment Methods: We accept payments via UPI, credit/debit cards, net banking, and digital wallets through our payment partner, Cashfree Payments.

No Recurring Fees: There are no monthly or annual subscription fees for the website itself. Domain and hosting renewals after the first year are at prevailing market rates, typically ₹1,000–₹2,000/year.

4. Delivery Timeline

We aim to deliver your completed website within 7 working days from the date we receive all required materials from you (business information, logo, photos, content). Delays in providing materials will extend the delivery timeline accordingly.

The delivery process includes: requirement gathering, design mockup, development, your review and feedback, final revisions, and launch.

5. Client Responsibilities

You agree to:

  • Provide accurate and complete business information
  • Supply necessary materials (logo, images, text content) in a timely manner
  • Review design mockups and provide feedback within 3 business days
  • Ensure that all materials provided do not infringe on any third-party intellectual property rights
  • Ensure that the content you provide is legal and does not violate any laws

6. Intellectual Property & Ownership

Your Ownership: Upon full payment and delivery, you own the complete website codebase, including all custom code written specifically for your project. This means you can modify, host, or transfer your website as you wish.

Our Retention: We retain the right to showcase your website in our portfolio and marketing materials unless you explicitly request otherwise in writing.

Third-Party Assets: Any stock images, fonts, or third-party libraries used in your website are subject to their respective licences and remain the property of their respective owners.

7. Revisions & Modifications

Pre-Launch Revisions: We offer unlimited revisions during the design mockup stage. Once development begins, we allow up to 2 rounds of minor revisions (text changes, colour adjustments, image swaps) at no extra cost.

Post-Launch Changes: Minor text or image updates after launch are provided free of charge on a best-effort basis. Structural changes, new pages, or feature additions are available at additional cost, discussed and agreed upon in advance.

8. Satisfaction Guarantee & Refund Policy

Satisfaction Guarantee: We work with you until you are satisfied with your website’s design and functionality, within the scope of the agreed deliverables.

Refund Before Work Begins: If you request a cancellation before any design or development work has commenced, you are entitled to a full refund of ₹5,499.

Refund After Work Begins: If work has already commenced (design mockup shared or development started), a partial refund may be issued depending on the stage of completion. We will discuss this on a case-by-case basis.

No Refund After Delivery: Once the final website has been delivered and you have approved it for launch, no refund will be issued.

9. Hosting & Domain

The first year of domain registration and hosting is included in the ₹5,499 package. Standard domains (e.g., .com, .in) with registration costs under ₹1,000 are covered. Premium or specialty domains may incur additional charges.

After the first year, domain and hosting renewals are your responsibility. We will notify you before expiry and assist with the renewal process. Typical renewal costs range from ₹1,000 to ₹2,000 per year.

10. Limitation of Liability

Vsurge Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website, including but not limited to: loss of revenue, loss of data, or business interruption.

Our total liability for any claim related to our services shall not exceed the amount you paid us for those services (₹5,499).

11. Disclaimer

While we build high-quality websites designed to attract customers, we do not guarantee specific business outcomes such as increased sales, leads, or Google rankings. Business results depend on many factors beyond the website itself, including your marketing efforts, product quality, and market conditions.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Patna, Bihar, India.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of our services after changes constitutes acceptance of the revised terms.
